Terms & Conditions

1. Agreement to Terms
By engaging Kemper Design Services, you agree to these terms and conditions. If you do not agree to any part of these terms, you may not use our services.

2. Services Scope
All projects are scoped in writing before work begins. The scope document defines deliverables, timeline, and fixed price. Any work outside the agreed scope requires written approval and additional pricing.

3. Payment Terms
Payment is due as specified in your project agreement. For most projects: 50% upon signed scope, 50% upon delivery. Late payments may result in project suspension until payment is received.

4. Ownership & Licensing
Upon final payment, you own all code, designs, and assets created during the project. We retain no licensing rights. You may use, modify, or distribute the work as you see fit.

5. Support & Maintenance
30 days of post-launch support is included with every project. After 30 days, ongoing support is available on a project basis and is not included unless otherwise agreed in writing.

6. Limitation of Liability
Kemper Design Services is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid for the project.

7. Confidentiality
We maintain strict confidentiality of your business information. Your data is never shared, sold, or used for any purpose other than delivering the agreed-upon services.

8. Changes to Terms
We reserve the right to update these terms. Material changes will be communicated in writing. Continued use of our services after changes constitutes acceptance.

Privacy Policy

1. Information We Collect
We collect information you provide directly: name, email, phone number, and project details shared during discovery calls and communications. We do not collect data beyond what's necessary to deliver your services.

2. How We Use Your Information
Your information is used solely to scope, deliver, and support your project. We never use your business data for marketing, training AI models, or any purpose beyond serving your engagement.

3. Data Security
We employ industry-standard security measures to protect your information. Your data is encrypted in transit and stored securely. We do not transmit or store your business data on public clouds without explicit consent.

4. Data Retention
We retain project information for 7 years to support potential follow-up work and legal compliance. After 7 years, data is securely deleted unless legal obligations require longer retention.

5. Third-Party Services
Our projects may integrate with third-party tools (Stripe, QuickBooks, etc.). We only share the data necessary for integration. You own and control accounts with these services.

6. AI & Machine Learning
We never train AI models on your business data. Any AI tools we implement are configured to prevent your data from being used for model training or other purposes beyond your direct use.

7. Cookies & Tracking
Our website may use cookies for analytics purposes only. We do not track individual users across websites or build behavioral profiles. You can disable cookies in your browser.

8. Your Rights
You have the right to access, correct, or delete your personal information at any time. Contact us to exercise these rights. We will respond within 10 business days.

Every project starts with a free discovery call — typically 30 minutes. We ask about your business, your workflows, and what's eating the most time. From there we produce a written scope with a fixed price and timeline.
It depends on the scope. A custom website is typically 2–3 weeks from signed scope to launch. An AI automation workflow is 3–5 weeks. A full custom application is 6–10 weeks. Format conversions and design can often turn around in 48–72 hours.
Not at all. We explain everything in plain language and don't assume any technical background. Our goal is that you finish every engagement understanding what was built and how to use it.
Yes. We don't rip and replace — we connect and extend. Whether you're using QuickBooks, Google Workspace, HubSpot, Calendly, or Shopify, our starting point is always your existing stack.
Pricing
Fixed price per project, agreed before any work begins. You will never receive an invoice larger than what you signed off on.
Our custom websites start at $999. That covers a fully designed, built, and launched site with up to 6 pages, contact forms, mobile optimization, and basic SEO setup.
Yes — no strings. We use it to understand your business and give you honest feedback. If we're not a good fit, we'll tell you and point you in a better direction.
For larger projects, we typically structure billing as 50% on signed scope and 50% on delivery. For projects over a certain threshold, we can discuss a milestone-based schedule.
Security & Data
Yes. We never store, share, or train on your business data. Every system we build is configured so your data stays on your infrastructure or in accounts you own and control.
Never. We only use enterprise-tier AI services with data processing agreements that explicitly prohibit training on customer data.
You do. Upon final payment, full ownership of the code, designs, and assets transfers to you. We don't retain licensing rights or lock you into proprietary systems.

Our notary services are US-based. Remote online notarization (RON) is available for many document types. For international documents, we can advise on what's required.
After Launch
Every project includes a 30-day support window after launch at no additional cost. During that window, we fix anything that underperforms or behaves unexpectedly.
Yes. Every delivery includes documentation and a handoff walkthrough. The goal is that your people own the tool confidently.
